These Terms of Service govern access to and use of The Visitor Hub, including the website, mobile app, visitor sign-in tools, disclosure workflows, event management features, and related services.
1. Acceptance of Terms
By accessing or using The Visitor Hub, you agree to these Terms. If you are using the service on behalf of a brokerage, team, company, or other organization, you represent that you have authority to use the service for that organization and to bind that organization to these Terms.
2. Use of the Platform
The Visitor Hub helps real estate professionals collect visitor information, manage open house or event workflows, organize follow-up information, support disclosure review and signature workflows, and maintain related records.
You agree to use the service only for lawful business purposes and in a way that is consistent with applicable real estate rules, brokerage policies, professional obligations, and these Terms.
3. Accounts, Team Access, and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Team leads, agents, and authorized users are responsible for assigning appropriate access, reviewing team activity, and removing access when it is no longer appropriate.
You agree to provide accurate account information and to keep profile, brokerage, contact, and event information reasonably current.
4. Visitor Information and Compliance
Agents, teams, and brokerages are responsible for determining what visitor information to collect, what questions to ask, how to use visitor information, and how long to retain records. You are responsible for using visitor information in compliance with applicable privacy laws, fair housing laws, real estate regulations, brokerage policies, MLS or board rules, and professional standards.
The Visitor Hub provides workflow and recordkeeping tools, but it does not provide legal, compliance, brokerage, or real estate advice.
5. Electronic Signatures and Disclosures
The service may allow visitors to review disclosures, acknowledge forms, provide electronic signatures, and generate signed disclosure records. You are responsible for selecting the correct disclosure forms, determining when signatures are required, confirming that the content is current and appropriate, and complying with state-specific and brokerage-specific requirements.
Electronic records and signatures may not be appropriate for every situation. You should consult your broker, board, association, or legal counsel when you are unsure about disclosure or signature requirements.
6. Follow-Up Communication
The service may support follow-up emails or related communications based on event and visitor information. You are responsible for ensuring that communications are appropriate, accurate, and compliant with applicable marketing, privacy, brokerage, and consumer communication rules.
7. Acceptable Use
You agree not to misuse the service, attempt unauthorized access, interfere with security or performance, upload malicious content, use the service to send unlawful or misleading communications, collect information without proper authority, or use the service in a way that violates the rights of others.
8. Service Availability and Changes
We aim to provide a reliable service, but we do not guarantee that the service will be uninterrupted, error-free, or available at all times. Features may be updated, changed, added, or removed as the product evolves.
9. Intellectual Property
The Visitor Hub, including its design, branding, software, workflows, website content, and product experience, is owned by The Visitor Hub or its licensors. You may not copy, modify, reverse engineer, resell, or create competing services from the platform except as permitted by law or with written permission.
10. User Content and Records
You retain responsibility for the information, records, files, notes, event details, visitor responses, disclosure selections, and other content you enter or upload into the service. You grant The Visitor Hub permission to process that content as needed to provide, secure, maintain, and improve the service.
11. Limitation of Liability
To the maximum extent permitted by law, The Visitor Hub is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, business, data, goodwill, or opportunities arising from use of the service.
The service is provided as a technology tool. Professional users remain responsible for their own legal, compliance, brokerage, disclosure, communication, and recordkeeping decisions.
12. Termination
We may suspend or terminate access to the service if we believe an account has violated these Terms, creates risk, misuses the platform, or is required to be restricted for legal, security, or operational reasons. You may stop using the service at any time.
13. Changes to These Terms
We may update these Terms from time to time as the service, legal requirements, or business practices change. The updated version will be posted on this page with a revised effective date.
